
CHAPTER X - THE OMBUDSMAN
| Section 122 (2) -Section 120 | creates the office of the Ombudsman expressly as a public office. However, in terms of section 122 (2) (f), no person can be appointed to the office of the Ombudsman if that person is a serving public officer and yet, also, in terms of section 128 (1) an Ombudsman is eligible for reappointment. |
| Thus, the disqualification in section 122 (2) on the ground that one is a serving public officer is wrong and illogical since it would extend to a serving Ombudsman whom section 120 says is a public officer and who is eligible for reappointment in terms of section 128 (1). |
