CHAPTER X - THE OMBUDSMAN

Section 122 (2) -Section 120 creates the office of the Ombudsman expressly as a public office. However, in terms of section 122 (2) (f), no person can be appointed to the office of the Ombudsman if that person is a serving public officer and yet, also, in terms of section 128 (1) an Ombudsman is eligible for reappointment.
   Thus, the disqualification in section 122 (2) on the ground that one is a serving public officer is wrong and illogical since it would extend to a serving Ombudsman whom section 120 says is a public officer and who is eligible for reappointment in terms of section 128 (1).
